Welcome to Haus of 86. These Terms of Service (“Terms”) govern your use of our website, services, bookings, installations, vehicle work, and purchases from hausof86.com. By accessing our website, placing an order, booking a service, supplying a vehicle for work, or otherwise engaging Haus of 86, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website, place an order, or book our services.


1. General Conditions

1.1. We reserve the right to refuse service to anyone for any reason at any time, including but not limited to suspected fraudulent activity, unsafe working conditions, abusive behaviour, unreasonable demands, non-payment, or behaviour we consider harmful to our business, staff, contractors, customers, suppliers, or reputation.

1.2. You agree not to use our website, products, services, vehicle work, advice, or supplied parts for illegal, unsafe, or unauthorised purposes.

1.3. You are responsible for ensuring that any parts, services, modifications, tuning, or vehicle use complies with all laws and regulations applicable in your state, territory, country, or intended place of use.

1.4. Any violation of these Terms may result in refusal of service, cancellation of bookings or orders, termination of access to our website, and/or further action where necessary.


2. Products, Services & Pricing

2.1. We aim to provide accurate product and service descriptions, pricing, availability, fitment information, and estimated timeframes. However, errors may occur and we do not guarantee that all information is complete, current, or error-free.

2.2. Prices are subject to change without prior notice due to supplier pricing changes, freight costs, currency fluctuations, promotions, market conditions, availability, or administrative error.

2.3. We reserve the right to modify, substitute, discontinue, refuse, or cancel any product or service at any time.

2.4. Product images, descriptions, specifications, and expected performance information are provided as guides only. Final appearance, fitment, compatibility, sound, performance, and results may vary depending on the vehicle, parts, configuration, condition, and use.

2.5. Where pricing is listed as “from”, “starting from”, “estimated”, or similar, the final price may vary depending on vehicle condition, selected options, required supporting parts, supplier costs, freight, access, location, additional work required, or changes requested by the customer.

2.6. Sales, discounts, promotional offers, bundle pricing, credits, or special offers may be subject to additional terms. Promotions cannot be combined unless expressly approved by Haus of 86.


3. Orders, Bookings & Payments

3.1. By placing an order or booking a service, you agree to provide accurate and complete customer, billing, shipping, vehicle, and contact information.

3.2. We may refuse or cancel an order or booking at our discretion, including where information is incomplete, payment has not been received, stock is unavailable, the vehicle is unsuitable, or the requested work is unsafe, unlawful, or outside the scope of what we are willing to perform.

3.3. Some bookings may require a deposit. Deposits are used to secure booking time, order parts, allocate labour, and cover administrative preparation.

3.4. Unless otherwise stated in writing, the remaining balance is payable on completion of the work, collection of the vehicle, or before release of the vehicle or goods.

3.5. We may withhold release of a vehicle, parts, goods, keys, documentation, or completed work until all amounts owing are paid in full, subject to applicable law.

3.6. Payment plans, split payments, Afterpay, or alternative payment arrangements are only available where offered and approved by Haus of 86.

3.7. Chargebacks, payment disputes, or reversed payments may result in recovery action, cancellation of future bookings, refusal of further work, and/or recovery of reasonable costs incurred.


4. Cancellations, Rescheduling & No-Shows

4.1. If you need to cancel or reschedule a booking, you must provide as much notice as possible.

4.2. Deposits may be non-refundable where parts have been ordered, time has been reserved, labour has been allocated, supplier cancellation fees apply, or preparation work has already commenced.

4.3. We may reschedule a booking due to weather, staff availability, supplier delays, safety concerns, workshop availability, vehicle access issues, or other circumstances beyond our reasonable control.

4.4. If a customer is not available at the agreed time or location, the vehicle is inaccessible, or the work area is unsuitable, additional fees may apply and the booking may be cancelled or rescheduled.


5. Shipping, Delivery & Stock Availability

5.1. We aim to process and ship orders in a timely manner. Delays may occur due to supplier delays, courier issues, customs, stock shortages, freight interruptions, or other circumstances beyond our control.

5.2. Stock availability and estimated delivery times are not guaranteed unless expressly confirmed in writing.

5.3. Once goods are dispatched, risk in transit may pass to the customer to the extent permitted by law. Customers must ensure shipping details are accurate.

5.4. Shipping costs, freight charges, call-out fees, delivery fees, or service-related travel charges may apply and will be displayed or advised where applicable.

5.5. Free shipping may apply only to eligible products. Service, installation, bulky, special-order, oversized, or supplier-direct items may be excluded.


6. Returns, Refunds & Special-Order Items

6.1. Returns due to change of mind are not accepted unless approved by Haus of 86 in writing.

6.2. Claims for defective, damaged, incorrect, or incomplete goods must be made as soon as possible after delivery or collection.

6.3. Returned items must be in original condition, unused, uninstalled, undamaged, and with original packaging unless otherwise required by law.

6.4. Special-order parts, imported parts, custom parts, electrical components, performance parts, installed parts, used parts, and customer-specific order items may not be returnable unless required by Australian Consumer Law.

6.5. Refunds, replacements, or exchanges will only be processed after inspection and assessment.

6.6. Nothing in these Terms excludes, restricts, or modifies any rights you may have under Australian Consumer Law.


7. Vehicle Work, Services & Installations

7.1. Haus of 86 may provide vehicle servicing, inspections, diagnostics, installations, modifications, performance upgrades, tuning-related support, mobile work, and workshop-based work.

7.2. By booking vehicle work, you confirm that you are the owner of the vehicle or are authorised by the owner to approve the work.

7.3. You authorise Haus of 86, its staff, contractors, suppliers, and approved partners to inspect, move, start, operate, test, road test, diagnose, work on, modify, tune, or otherwise handle the vehicle as reasonably required to perform the agreed work.

7.4. Vehicle work is carried out based on the condition of the vehicle at the time it is presented. We are not responsible for pre-existing faults, wear, damage, poor previous workmanship, incorrect prior modifications, hidden defects, aged components, rust, seized fasteners, brittle plastics, leaking seals, damaged wiring, weak batteries, worn driveline components, or other issues not caused by our negligence.

7.5. During servicing, repairs, modification, disassembly, tuning, or testing, pre-existing or weakened components may fail or become apparent. You acknowledge that this risk is inherent when working on used, modified, aged, high-performance, or track-used vehicles.

7.6. If additional issues are discovered during work, we may pause the job and seek approval for further work, parts, labour, or diagnosis. Additional work is not included unless expressly agreed.

7.7. Estimated completion times are estimates only and may change due to parts delays, vehicle condition, complexity, seized or damaged components, prior modifications, diagnostic findings, workshop availability, or other circumstances.

7.8. We may refuse to continue work where the vehicle is unsafe, unroadworthy, incorrectly modified, contaminated, excessively damaged, structurally compromised, or otherwise unsuitable for the requested work.

7.9. Unless expressly stated, service and installation work does not include unrelated repairs, rectification of prior workmanship, engineering certification, roadworthy certification, registration compliance, emissions testing, defect clearance, insurance approval, or legal compliance assessment.


8. Mobile Services

8.1. Some services may be offered as mobile services at a customer’s home, workplace, or nominated location.

8.2. The customer is responsible for providing a safe, legal, level, accessible, and suitable working area with adequate space, lighting, access, and permission for work to be carried out.

8.3. Mobile work may be refused, cancelled, rescheduled, or moved to a workshop if weather, access, safety, vehicle condition, lack of space, strata/building rules, public area restrictions, or other site conditions make the job unsuitable.

8.4. The customer is responsible for ensuring that work can legally and safely be carried out at the nominated location.

8.5. If a vehicle cannot be completed on-site due to unexpected issues, further diagnosis, additional parts, towing, transport, workshop access, or additional labour may be required at the customer’s expense.


9. Performance Modifications, Turbo Kits, Tuning & Track Use

9.1. Performance modifications may increase stress on the engine, gearbox, clutch, differential, driveshafts, cooling system, fuel system, suspension, brakes, tyres, and other vehicle components.

9.2. Turbocharging, forced induction, exhaust modifications, ECU flashing, tuning, E85/flex fuel, higher RPM use, track use, drifting, motorsport, and aggressive driving can increase the risk of component wear, failure, overheating, engine damage, drivetrain damage, and reduced service life.

9.3. You acknowledge that performance modifications carry risk and may affect reliability, drivability, fuel economy, emissions compliance, noise compliance, insurance, warranty, registration status, and road legality.

9.4. No specific power, torque, boost, sound level, reliability outcome, fuel economy, lap time, or performance result is guaranteed unless expressly stated in writing.

9.5. Published or discussed power figures are estimates only and may vary depending on dyno type, fuel, boost level, supporting modifications, vehicle condition, environmental conditions, tuning strategy, and measurement method.

9.6. Supporting modifications may be required or strongly recommended. This may include, but is not limited to, oil cooling, clutch, fuel system, exhaust, engine mounts, braking, tyres, suspension, catch cans, cooling system upgrades, driveline upgrades, and increased maintenance.

9.7. Where a customer declines recommended supporting modifications, inspection, servicing, repairs, or safety items, Haus of 86 is not responsible for failures, performance limitations, drivability issues, or damage that may arise from proceeding without those recommendations.

9.8. ECU tuning may be carried out by Haus of 86 or by a trusted tuning partner. Tuning outcomes depend on vehicle condition, hardware, fuel quality, sensor accuracy, and supporting systems.

9.9. Motorsport, drifting, track driving, drag racing, roll racing, competition use, high-boost use, limiter abuse, overheating, oil starvation, poor maintenance, incorrect fuel, or misuse may void any workmanship support or warranty offered by Haus of 86 to the extent permitted by law.

9.10. Some products and modifications may be intended for off-road, track, motorsport, or competition use only. The customer is responsible for confirming whether a part or modification is legal for road use in their jurisdiction.


10. Customer-Supplied Parts

10.1. Where we agree to install customer-supplied parts, the customer is responsible for ensuring those parts are correct, genuine, complete, safe, compatible, legal, and fit for purpose.

10.2. We are not responsible for defects, failures, missing hardware, incorrect fitment, poor manufacturing quality, counterfeit parts, used parts, damaged parts, or compatibility issues relating to customer-supplied parts.

10.3. Additional labour, diagnosis, modification, replacement parts, or rework caused by incorrect, incomplete, defective, or poor-quality customer-supplied parts may be charged to the customer.

10.4. Any warranty for customer-supplied parts remains between the customer and the supplier or manufacturer.

10.5. We may refuse to install parts we consider unsafe, unsuitable, poor quality, illegal, or likely to compromise the vehicle.


11. Used Parts, Imported Parts & Special Components

11.1. Used parts, imported parts, rare parts, discontinued parts, custom parts, and motorsport parts may carry additional risk.

11.2. Used parts may show wear, age, damage, fatigue, contamination, or hidden defects. Unless expressly stated, used parts are supplied as-is to the extent permitted by law.

11.3. Imported or special-order parts may have extended lead times and may not be returnable once ordered.

11.4. Manufacturer warranties, supplier warranties, and availability of replacement parts may vary.


12. Diagnostics & Inspection

12.1. Diagnostic work is performed using available information, symptoms, testing, tools, experience, and reasonable professional judgment.

12.2. Diagnosis may require staged testing. Some faults may only appear under certain conditions or after other issues are repaired.

12.3. A diagnostic fee does not guarantee that every fault will be identified immediately or that a repair will be completed within the initial diagnostic period.

12.4. If further testing, disassembly, parts, or specialist support are required, additional charges may apply.


13. Vehicle Storage, Collection & Abandoned Vehicles

13.1. Vehicles must be collected promptly once work is completed, unless otherwise agreed.

13.2. Storage fees may apply where a vehicle is not collected within a reasonable time after notification of completion.

13.3. If a vehicle is left unpaid, uncollected, or abandoned, we may take steps permitted by law to recover unpaid amounts, storage costs, towing costs, administrative costs, and any other reasonable expenses.


14. Customer Responsibilities

14.1. You must provide accurate information about the vehicle, including known faults, prior modifications, tuning history, accident history, engine swaps, previous repairs, fluid leaks, warning lights, noises, overheating, track use, and any other relevant issues.

14.2. You must ensure the vehicle has sufficient fuel, battery charge, access, keys, security codes, wheel lock keys, and any required parts or information for the work to proceed.

14.3. You must follow maintenance, inspection, running-in, tuning, fuel, oil, boost, and usage instructions provided by Haus of 86 or its partners.

14.4. After performance work, you are responsible for ongoing maintenance, monitoring fluids, checking for leaks, listening for abnormal noises, avoiding abuse, and arranging follow-up inspections where recommended.

14.5. Failure to follow advice, maintenance requirements, or recommended inspection intervals may affect reliability and any support we are able to provide.


15. Warranty, Workmanship & Australian Consumer Law

15.1. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

15.2. For major failures with services, you may be entitled to cancel the service contract and receive a refund for the unused portion or compensation for the reduced value. You may also be entitled to compensation for any other reasonably foreseeable loss or damage. The ACCC publishes mandatory wording for warranties against defects for goods and services supplied in Australia.

15.3. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, remedy, or protection that cannot be excluded under Australian Consumer Law.

15.4. Subject to Australian Consumer Law, any warranty or support provided by Haus of 86 applies only to workmanship performed by Haus of 86 and does not cover:

  • pre-existing faults or wear;
  • customer-supplied parts;
  • used parts;
  • supplier/manufacturer defects;
  • incorrect use, abuse, neglect, overheating, oil starvation, missed maintenance, incorrect fuel, track use, motorsport use, drifting, competition use, or excessive load;
  • failures caused by declined recommended work or supporting modifications;
  • failures caused by third-party work, later modifications, or tampering;
  • unrelated vehicle issues.

15.5. Parts warranty, where applicable, is generally provided by the manufacturer or supplier. Haus of 86 may assist with warranty communication where reasonable, but we do not control supplier or manufacturer warranty decisions.

15.6. Warranty claims may require inspection by Haus of 86. The customer must provide the vehicle, relevant information, photos, videos, logs, invoices, and any requested evidence.

15.7. We may refuse warranty support where a vehicle has been altered, tuned, damaged, abused, disassembled, repaired by another party, used in motorsport, or where the issue cannot reasonably be attributed to our workmanship.


16. Test Drives, Road Testing & Data Logging

16.1. You authorise Haus of 86 and approved partners to operate, road test, data log, diagnose, and inspect the vehicle as reasonably required.

16.2. Road testing and logging may be necessary to confirm repairs, tuning, drivability, noise, boost control, braking, clutch operation, steering, suspension, or other vehicle behaviour.

16.3. While reasonable care will be taken, you acknowledge that road testing modified, high-powered, worn, or previously faulty vehicles carries inherent risk.


17. Media, Photos & Documentation

17.1. We may take photos, videos, diagnostic records, scan data, tuning logs, and inspection notes for quality control, proof of condition, customer communication, marketing, warranty assessment, and business records.

17.2. We may use non-identifying images or videos of vehicles and work performed for marketing or educational purposes unless you request otherwise in writing before work begins.

17.3. We will not intentionally publish personal information, number plates, addresses, or identifying customer details without consent.


18. Intellectual Property

18.1. All content on our website, including logos, images, text, layout, product descriptions, guides, and branding, is owned by Haus of 86 or used under licence and is protected by intellectual property laws.

18.2. You may not use our branding, product images, website content, written content, or proprietary materials without prior written permission.

18.3. Third-party trademarks, brand names, and logos displayed on our website belong to their respective owners and do not imply endorsement or affiliation unless expressly stated.


19. User Submissions

19.1. If you send us reviews, photos, videos, comments, suggestions, ideas, proposals, feedback, or other materials, you agree that we may use, edit, publish, reproduce, display, or distribute those materials for business, marketing, educational, or promotional purposes unless otherwise agreed in writing.

19.2. We are not required to maintain submissions in confidence, pay compensation, or respond to submissions.

19.3. You must not submit unlawful, offensive, defamatory, misleading, or infringing content.


20. Limitation of Liability

20.1. To the maximum extent permitted by law, Haus of 86 is not liable for indirect, incidental, special, consequential, or economic loss, including loss of profits, loss of use, loss of opportunity, loss of data, business interruption, towing costs, accommodation, hire car costs, missed events, track day costs, or other consequential losses.

20.2. To the maximum extent permitted by law, our liability is limited to the amount paid by you for the relevant product or service giving rise to the claim.

20.3. We are not liable for loss, damage, failure, or cost caused by pre-existing vehicle condition, customer-supplied parts, third-party parts, third-party workmanship, misuse, illegal use, motorsport use, failure to follow advice, declined recommendations, or factors outside our reasonable control.

20.4. Nothing in this section excludes liability that cannot be excluded under Australian Consumer Law or other applicable law.


21. Indemnity

21.1. You agree to indemnify Haus of 86, its owner, employees, contractors, suppliers, and partners against claims, losses, damages, liabilities, costs, and expenses arising from:

  • your breach of these Terms;
  • inaccurate information supplied by you;
  • unauthorised use of a vehicle;
  • illegal or unsafe vehicle use;
  • customer-supplied parts;
  • use of the vehicle after modification;
  • track, drift, motorsport, racing, or competition use;
  • failure to follow advice, maintenance, or safety recommendations.

22. Website Use & Availability

22.1. We do not guarantee that our website, checkout, product pages, booking forms, emails, or online services will be uninterrupted, secure, or error-free.

22.2. We may update, remove, modify, or suspend website content, products, services, or features at any time without notice.


23. Privacy

23.1. Personal information is handled in accordance with our Privacy Policy.

23.2. We may collect and use customer, vehicle, order, booking, payment, and communication information to provide products and services, manage bookings, communicate with customers, keep records, meet legal obligations, and improve our business.


24. Governing Law

24.1. These Terms are governed by the laws of Australia.

24.2. Any dispute arising from these Terms, our website, products, services, or vehicle work will be dealt with in the courts and tribunals of Australia, subject to applicable law.


25. Changes to Terms

25.1. We may update these Terms at any time by posting the updated version on our website.

25.2. Changes take effect immediately upon posting unless otherwise stated.

25.3. Your continued use of our website, products, services, bookings, or vehicle work after changes are posted means you accept the updated Terms.
